अधिनियम का कतिपय संगठनों को लागू न होना (Act not to apply in certain organisations)
यह धारा आरटीआई अधिनियम के उन संगठनों पर लागू न होने का प्रावधान करती है, जो देश की सुरक्षा, खुफिया जानकारी, और कानून व्यवस्था से संबंधित हैं। इन संगठनों की सूची अधिनियम की दूसरी अनुसूची में दी गई है। हालांकि, यह छूट पूरी तरह से नहीं है। यदि इन संगठनों में भ्रष्टाचार या मानव अधिकारों के उल्लंघन का मामला है, तो आरटीआई के तहत जानकारी माँगी जा सकती है।
1. केंद्रीय आसूचना और सुरक्षा संगठन (धारा 24(1))
मूल पाठ (हिंदी): इस अधिनियम में निहित कोई भी बात, केंद्र सरकार द्वारा स्थापित उन आसूचना और सुरक्षा संगठनों पर लागू नहीं होगी जो दूसरी अनुसूची में सूचीबद्ध हैं, न ही इन संगठनों द्वारा सरकार को दी गई किसी भी जानकारी पर।
आपकी टिप्पणी: इन संगठनों में **खुफिया ब्यूरो, अनुसंधान और विश्लेषण विंग (RAW), प्रवर्तन निदेशालय (ED), सीमा सुरक्षा बल (BSF)**, और अन्य शामिल हैं। इन संगठनों द्वारा सरकार को दी गई कोई भी सूचना आरटीआई के दायरे से बाहर होती है, सिवाय **भ्रष्टाचार और मानव अधिकारों के उल्लंघन** से संबंधित मामलों के।
यदि सूचना मानव अधिकारों के उल्लंघन से संबंधित है, तो इसे केवल **केंद्रीय सूचना आयोग** की अनुमति के बाद ही दिया जाएगा। ऐसी जानकारी अनुरोध प्राप्त होने के **45 दिनों** के भीतर प्रदान की जाएगी, भले ही धारा 7 में कुछ भी लिखा हो।
Original Text (English): Nothing contained in this Act shall apply to the intelligence and security organisations specified in the Second Schedule, being organisations established by the Central Government or any information furnished by such organisations to that Government.
Your Note: This includes organizations like the **Intelligence Bureau, Research and Analysis Wing (RAW), Directorate of Enforcement (ED), Border Security Force (BSF)**, and others. Any information provided by these organizations to the government is outside the purview of the RTI Act, except for cases related to **corruption and human rights violations**.
If the information sought is about human rights violations, it will only be provided after the approval of the **Central Information Commission**. Such information must be provided within **45 days** from the date of the request, notwithstanding anything contained in Section 7.
2. अनुसूची में संशोधन (धारा 24(2) और (3))
मूल पाठ (हिंदी): केंद्र सरकार, राजपत्र में अधिसूचना जारी करके, अनुसूची में किसी अन्य आसूचना या सुरक्षा संगठन को जोड़ सकती है या हटा सकती है। ऐसी अधिसूचना के प्रकाशित होते ही, उस संगठन को अनुसूची में शामिल या उससे हटा हुआ माना जाएगा।
धारा 24(2) के तहत जारी की गई प्रत्येक अधिसूचना को संसद के दोनों सदनों के समक्ष रखा जाएगा।
आपकी टिप्पणी: केंद्र सरकार के पास यह अधिकार है कि वह समय-समय पर राजपत्र में अधिसूचना जारी करके इस सूची को संशोधित कर सके। इस प्रकार किए गए हर संशोधन को संसद के सामने प्रस्तुत करना अनिवार्य है।
Original Text (English): The Central Government may, by notification in the Official Gazette, amend the Schedule by including therein any other intelligence or security organisation established by that Government or omitting therefrom any organisation already specified therein and on the publication of such notification, such organisation shall be deemed to be included in or, as the case may be, omitted from the Schedule. Every notification issued under section 24(2) shall be laid before each House of Parliament.
Your Note: The Central Government has the authority to amend this list by issuing a notification in the Official Gazette. It is mandatory for every such notification to be placed before both Houses of Parliament.
3. राज्य आसूचना और सुरक्षा संगठन (धारा 24(4) और (5))
मूल पाठ (हिंदी): इस अधिनियम का कोई भी प्रावधान उन आसूचना और सुरक्षा संगठनों पर लागू नहीं होगा जो राज्य सरकार द्वारा स्थापित हैं और जिन्हें राज्य सरकार समय-समय पर राजपत्र में अधिसूचना द्वारा निर्दिष्ट करे।
परन्तु, भ्रष्टाचार और मानव अधिकारों के उल्लंघन से संबंधित सूचना को इस उप-धारा से बाहर नहीं रखा जाएगा। ऐसी सूचना राज्य सूचना आयोग के अनुमोदन के बाद ही दी जाएगी और अनुरोध प्राप्त होने के 45 दिनों के भीतर प्रदान की जाएगी।
धारा 24(4) के तहत जारी की गई प्रत्येक अधिसूचना राज्य विधानमंडल के समक्ष रखी जाएगी।
आपकी टिप्पणी: जिस तरह केंद्र सरकार के लिए कुछ संगठन सूचीबद्ध हैं, उसी तरह राज्य सरकार भी अपने कुछ सुरक्षा और आसूचना संगठनों को आरटीआई से छूट दे सकती है। हालांकि, यहां भी, **भ्रष्टाचार और मानव अधिकारों के उल्लंघन** से जुड़ी जानकारी पर आरटीआई लागू होगा।
Original Text (English): Nothing contained in this Act shall apply to such intelligence and security organisation being organisations established by the State Government, as that Government may, from time to time, by notification in the Official Gazette, specify. Provided that the information pertaining to the allegations of corruption and human rights violations shall not be excluded under this sub-section. Provided further that in the case of information sought for is in respect of allegations of violation of human rights, the information shall only be provided after the approval of the State Information Commission and, notwithstanding anything contained in section 7, such information shall be provided within forty-five days from the date of the receipt of request. Every notification issued under section 24(4) shall be laid before the State Legislature.
Your Note: Similar to the Central Government, a State Government can also exempt certain security and intelligence organizations from the RTI Act. However, here too, the RTI Act will apply to information related to **corruption and human rights violations**.
